These Terms apply to all orders placed through our online store and to the use of our website. Our store is operated from Germany and may sell to customers in Germany, the European Union, and internationally.
- Products and product information
We sell physical products under the BARBARIAN GOLD® brand. Product descriptions, images, colors, measurements, availability, and prices are provided with reasonable care. Minor differences may occur due to screen settings, production tolerances, materials, or product updates.
Products are intended for normal lawful use. Customers are responsible for checking whether a product is suitable for their intended use and whether it may lawfully be imported into their destination country.
- Orders and contract formation
By placing an order, you make a binding offer to purchase the selected products. We may accept the order by sending an order confirmation, shipping confirmation, or by dispatching the goods.
We may refuse or cancel an order where legally permitted, for example if products are unavailable, payment fails, information is incorrect, fraud or abuse is suspected, or delivery to the selected destination is not possible.
- Prices, tax status, payment, and invoices
Prices are shown in the currency displayed at checkout. Shipping costs, customs duties, import taxes, brokerage fees, local taxes, and other destination charges may apply unless expressly stated otherwise at checkout.
BARBARIAN GOLD® is operated as a German sole proprietorship. Based on our current tax status as a small business within the meaning of Section 19 of the German VAT Act, VAT is not charged or shown separately on invoices. If our tax status changes, product prices, invoices, and tax wording may be adjusted accordingly.
Payment methods available at checkout are provided by Shopify and payment service providers. Payment must be completed before goods are dispatched unless another payment method is expressly offered.
- Discount codes, ambassador codes, and affiliate codes
Discount, ambassador, affiliate, creator, or referral codes may be offered from time to time. Codes may be subject to conditions, expiry dates, minimum order values, product exclusions, region restrictions, or fraud-prevention checks.
Codes have no cash value and may be changed, suspended, or withdrawn where legally permitted. If an order is refunded, cancelled, charged back, or identified as abusive, the related discount or commission attribution may be reversed.
BARBARIAN GOLD® may work with ambassadors, affiliates, creators, or similar partners who can receive commission for qualifying sales. These commercial arrangements are governed by separate agreements between BARBARIAN GOLD® and the relevant partner. Partners are responsible for clearly disclosing their commercial relationship where required by applicable advertising, influencer, consumer protection, or platform rules.
- Shipping and delivery
We ship to Germany, the European Union, and internationally to the countries available at checkout.
Orders are usually processed within 1 to 3 business days after successful payment, unless stated otherwise on the product page or during checkout.
Business days are Monday through Friday, excluding public holidays at our business location and, where relevant, carrier or destination non-operating days. Saturdays, Sundays, and public holidays are not counted in business-day processing or delivery estimates and may extend those estimates.
Estimated delivery times:
Germany: 2 to 5 business days after dispatch
European Union: 3 to 10 business days after dispatch
International outside the EU: 7 to 21 business days after dispatch
Delivery times are estimates and may be affected by carriers, customs, holidays, destination rules, or events outside our control.
Free standard shipping thresholds:
Germany: free standard shipping from EUR 75
European Union: free standard shipping from EUR 125
International outside the European Union: free standard shipping from EUR 175 or the equivalent amount shown at checkout
Free shipping applies only to standard outbound shipping selected at checkout. It does not include express shipping, return shipping, customs duties, import taxes, brokerage fees, local taxes, or charges imposed by authorities, carriers, or customs offices.
For deliveries outside the European Union, the customer is responsible for customs duties, import taxes, brokerage fees, local taxes, and import compliance unless checkout expressly states otherwise. This also applies where the order qualifies for free standard shipping.
For consumers under German and EU law, the risk of accidental loss or damage passes only when the goods are delivered to the customer or to a recipient designated by the customer, unless the customer selected a carrier not offered by us.
- Right of withdrawal, returns, and hygiene-sensitive products
Consumers in the European Union have a statutory 14-calendar-day right of withdrawal as described in our Withdrawal and Return Policy. Customers outside the European Union are offered a voluntary 14-calendar-day return period under that policy, without limiting any mandatory local consumer rights.
All 14-day periods under our Withdrawal and Return Policy are calculated in calendar days. Saturdays, Sundays, and public holidays are included. If the final day falls on a Saturday, Sunday, or legally recognized public holiday at the customer's place of residence, the deadline is extended to the next day that is not a Saturday, Sunday, or public holiday.
Nothing in these Terms limits mandatory consumer withdrawal, warranty, defect, refund, or other non-waivable rights.
Customers may inspect goods as reasonably necessary to check their nature, characteristics, and functioning.
For hygiene-sensitive products and products with direct skin contact, including wraps, straps, sleeves, apparel accessories, and similar items, returned goods must be clean, unused, unwashed, and free from sweat, odor, stains, hair, skin residue, deodorant, perfume, or other signs of use.
If a product is returned in a condition that goes beyond necessary inspection, we may deduct compensation for loss in value from the refund. If the product can no longer be resold for hygiene or condition reasons, this loss in value may amount to the full purchase price, to the extent permitted by law.
If hygiene-sensitive goods are delivered sealed and the hygiene seal or sealed packaging has been removed after delivery, the right of withdrawal may be excluded where the goods are not suitable for return for health protection or hygiene reasons.
- Statutory warranty and defective goods
Mandatory statutory warranty rights apply. If a product is defective, damaged, or not as described, customers may have rights to repair, replacement, refund, price reduction, or other remedies under applicable law.
These rights are separate from voluntary returns and remain unaffected by any hygiene or return condition rules.
- Customer accounts
Customer accounts may be optional. You are responsible for keeping your login details secure and for providing accurate account, billing, and shipping information.
- Reviews, feedback, and user content
If you submit reviews, ratings, photos, comments, or other content, you confirm that the content is accurate, lawful, and does not infringe third-party rights.
You grant us the right to display, reproduce, moderate, translate, and use submitted content for store, product, marketing, and customer information purposes, to the extent permitted by law. We may use review providers such as Judge.me and Loox to collect, verify, moderate, and display reviews.
- Intellectual property
All trademarks, logos, product names, images, text, designs, and other content on this website are owned by BARBARIAN GOLD® or used with permission. You may not copy, reproduce, distribute, modify, or use our content for commercial purposes without prior written consent.
- Third-party services and Shopify
Our store is powered by Shopify. We may use Shopify services, payment providers, shipping providers, review providers, consent tools, analytics tools, marketing tools, affiliate or ambassador tools, and other service providers to operate the store.
Third-party services may be subject to their own terms and privacy policies. We are responsible for our products and store content, but not for independent third-party websites or services outside our control.
- Prohibited use
You may not use the website or services unlawfully, fraudulently, abusively, or in a way that interferes with security, checkout, payment, customer accounts, reviews, discount codes, tracking systems, or other store functions.
- Liability
Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, mandatory product liability, statutory warranty rights, or other liability that cannot be excluded under applicable law.
For ordinary negligence, we are liable only for breach of essential contractual obligations and only for foreseeable typical damage, unless mandatory law provides otherwise.
- Privacy
We process personal data according to our Privacy Policy. This includes data processing for orders, payments, shipping, customer support, cookies, consent management, reviews, marketing, analytics where enabled, and affiliate or ambassador attribution.
- Governing law and dispute resolution
These Terms are governed by German law, without depriving consumers of mandatory consumer protection rights that apply in their country of residence.
The European Online Dispute Resolution platform was discontinued on July 20, 2025. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise.
- Changes
We may update these Terms when our business, tools, shipping regions, tax status, legal obligations, or services change. The version available at the time of purchase applies to the order unless mandatory law provides otherwise.
